Solicitors administering estates often need specialist valuations for items outside their expertise. Antique rugs and carpets are among the most commonly misunderstood categories in probate inventories — they are frequently either overlooked entirely or assigned a value based on a generic estimate that bears no relation to the actual market.

We provide written probate valuations in a format suitable for submission to HMRC and for estate administration. Note: A probate valuation for IHT purposes must reflect fair market value at the date of death, not a discounted trade price or a conservative estimate. An undervaluation can expose the executor to challenge from HMRC.

What a Probate Valuation Is

A probate valuation establishes the open market value of an item at the date of death — the price it would achieve if sold on the open market between a willing buyer and a willing seller. For inheritance tax purposes, HMRC requires that assets be reported at this value, not at a discounted or clearance price.

What a Probate Valuation Is Not

A probate valuation is not an insurance replacement value (which reflects the cost of buying a comparable item at retail) and is not a purchase offer (which reflects what a dealer will pay net of their costs and profit margin). These three figures — probate value, insurance value, and purchase price — are all different, and confusing them can cause problems.

Valuation vs. Purchase Offer

We provide both services, and in practice the two often proceed together. We assess the rug, provide a written probate valuation at open-market value, and separately provide a purchase offer. Our purchase offer will be below the probate value — this is normal and expected, as any purchaser needs to cover costs and achieve a margin. The probate valuation is what we say the rug is worth on the market; the purchase offer is what we will pay to take it off your hands.

Fee Structure

We charge a fee for standalone written probate valuations. This fee is waived in full if we subsequently purchase the items valued. In practice, most estate clients who commission a valuation proceed to a sale, so in the majority of cases the valuation is effectively free.

A probate valuation is a written assessment of the fair market value of an item for estate administration and inheritance tax purposes — what the item would likely achieve on the open market. A purchase offer is what we will pay to purchase the item from the estate. Our purchase offers reflect the same market assessment as our valuations, but are somewhat below full market value as we take on resale costs and risk.
